The Ontario Superior Court of Justice has approved a settlement of proceedings against The Personal Insurance Company.
It is alleged that the company failed to comply with implied terms of its contractual obligations to clients when it accessed its insureds’ credit scores as part of its claims management process when clients made claims under their automobile insurance policies.
The company will pay $2,200,000 to settle the class action without making any admission or findings of liability or wrongdoing. Under the settlement, Personal will receive a comprehensive release from class members who receive payment. Any class member who does not wish to be bound by the results of the action and settlement must opt out no later than Dec. 6, 2019.
Clients included in the class include those who were insured by Personal under a valid automobile insurance policy between January 2012 and May 2019, and who made an insurance claim under that policy during that time. Law firm Waddell Phillips Professional Corporation says there are approximately 8,525 class members; if every class member receives a payment, each would receive approximately $150. The deadline to submit a valid claim form is Feb. 7, 2020.
