Failing to respond to a formal demand for information sent by priority mail will cost former agent, Crystal Bonthoux, $1,000 following a decision made by the Alberta Insurance Council’s General Insurance Council, to fine Bonthoux for ignoring the regulator’s requests for information.

A general level 2 certificate of authority holder until December 2021 when the certificate of authority was terminated, Bonthoux was required to make contact with the regulator in response to an investigation it was conducting into her conduct after a complaint was made against the agent.

The council says investigators sent the request for information twice by priority mail. “To date, the agent has not responded to the demand,” the council states in its decision.

“The public relies on the Alberta Insurance Council to investigate complaints and the (Insurance) Act requires that current and former certificate holders produce information when called upon. The council is of the view that the public is not well-served when an insurance intermediary simply ignores demands like those made in this situation.” 

They add that council is of the view that a significant civil penalty is warranted in the circumstances. It levied a penalty of $1,000, the maximum it could call for in the case.
